Workable Serviced Plot Definition

    Hi, Taking into account the serviced plot definition in the S&CBAct Gateshead Council is keen to agree a more concise definition that more realistically defines what people joining the register can expect. We are keen to keep this as flexible as possible to accommodate different models of developing serviced plots. Ideas from Council’s very welcome.

    Committee have just added a clause to the Housing & Planning Bill allowing for regulations to amend the definition so the existing definition in the Act of having access to public highway and connections for water, waste water and electricity could change at any time.

    Our first 2 pilot sites don’t have access to public highway so don’t qualify under this definition. They will both have a private roadway which will be transferred with the plots but it would cost too much to build these to adoptable standards.

    Liz- have you taken legal advice on your reading of the reference to “access to a public highway”, regarding whether a plot is considered to be serviced? If you have a pilot site(s) which include serviced plots that are connected to a public highway via an unadopted private road, and the plots have connections to electricity, water and waste water, the plots are deemed ‘serviced’. If this is not your understanding, there is scope to ask DCLG to clarify this as part of the drafting of any guidance or, possibly, secondary legislation to accompany the new legislation when it is commenced. If you can’t wait then ask for written clarification.
